Definitions:

“Products” shall mean all goods made available by Craft Sparrow for sale on the Website, whether customized or not;

“Services” shall mean all applications, software and services made available by Craft Sparrow on the Website;

“Terms of Use” shall mean the Terms as set out here under; and

Scope of Terms of Use:

These Terms of Use govern your use of the Website, purchase of Products, and use of all Services available via the Website, except to the extent that any Products or Services are the subject of a separate agreement.

Limitations on website use:

By using the Website, you agree that you own all copyright and other intellectual property over any materials uploaded by you (or that you are authorised by the owner of such intellectual property to use such materials). Craft Sparrow shall not be responsible in any form or manner for the misuse or infringement of such intellectual property. You also agree that in case of loss of package or any non-delivery thereof, Craft Sparrow shall not be responsible for any subsequent loss of your data and material, or misuse of your data and material by any third party.

You further agree that you shall not use the Website for any infringement of any intellectual property rights, criminal activity, or for any other violation of the law. Craft Sparrow shall not be held liable for any such infringement, criminal activity, or any other violation of the law.

By using this Website, you agree that the Products advertised on the Website may vary from their description on the Website. Any and all references, images, prices, specifications, designs, and availability of the Products are subject to change without notice. You further agree that as for sale on the Website are highly customized, unique, and specialized, you shall not be entitled to exchanges for any of the Products purchased by you on the Website. You also agree that refunds shall only be provided for products determined to be defective by Craft Sparrow, for an amount at the sole discretion of Craft Sparrow, and only in the form of store credits/transfer issued by Craft Sparrow. Craft Sparrow reserves the right to make and amend return polices from time to time.

Craft Sparrow further reserves the right to investigate complaints or reported violations of the Terms of Use and to take any action it deems fit, including but not limited to reporting any suspected unlawful activity to government authorities, police, regulators, or other third parties and disclosing any information to such persons or entities in connection with e-mail addresses, usage and purchase history, IP addresses and traffic information.

Modifications:

Craft Sparrow may revise and update these Terms of Use at any time at its sole discretion. Your continued usage of the Website after any changes to these Terms of Use will be deemed as acceptance of the said changes. Any aspect of the Website may be changed, supplemented, deleted or updated without notice, at the sole discretion of Craft Sparrow. Craft Sparrow may also change or impose fees for products and services provided through the Website at any time, at its sole discretion. You are responsible for regularly reviewing the Terms of Use.

Returns, Refunds, and Exchanges:

Please note that in case of returns and refunds, all products must be in unused condition with all labels and packing intact. Exchanges are available only on specified products. The terms and conditions for specific categories of product are as below:

I don’t like the product / I don’t want what I ordered: If you do not like the product you received or you ordered a wrong product, please write to the customer support team of Craft Sparrow at customercare@craftsparrow.in with your order number within 24 hours of receiving the shipment No claims/complaints made after 24 hours post receipt shall be entertained. All products must necessarily be in unused condition with all packaging and labels intact. No claims/complaints made after 24 hours post receipt shall be entertained. Once your request is reviewed and accepted on a preliminary basis by Craft Sparrow, you are required to self-ship the product to Craft Sparrow, Flat no.3, Lane next to Times office, Aurangabad Times Colony, Aurangabad, Maharashtra – 431001. You agree that the costs for the shipment shall be borne by you. For best service network, you may use IndiaPost. Refunds for products that you did not like will be given to you in the form of coupons, which may be availed on your next purchase at www.craftsparrow.in.

Damaged: In case the product received is damaged, or different from the one ordered, please write to us at customercare@craftsparrow.in within 48 hours of receiving the product along with the pictures of the defect. No claims/complaints made after 48 hours post receipt shall be entertained. Once your claim is received, reviewed and accepted on a preliminary basis by Craft Sparrow, Craft Sparrow shall arrange for a reverse pick-up for the same. Once the returned product(s) are received back, they will be checked. Upon satisfaction, Craft Sparrow will issue credits in the form of a coupon code or a refund to the original mode of payment. This process will take 7-10 working days (Saturdays, Sundays and Public Holidays not included) from the date of raising the return request.

General conditions of return for all products

Incomplete order/Product missing: If you did not receive a product in your package or find that the product is missing, please write to the customer support team of Craft Sparrow at customercare@craftsparrow.in with your order number within 48 hours of receiving the shipment. No claims/complaints made after 48 hours post receipt shall be entertained. Upon investigation and acceptance of your claim, Craft Sparrow will dispatch a new product or provide you with a refund or a coupon code or refund to the original mode of payment (as preferred by you). Any claims made beyond 48 hours shall not be accepted.

Package status is RTO or Return to origin:

In case the package is Returned to Origin, please write to us at customercare@craftsparrow.in with your order number. In case the return is made without any delivery attempt, Craft Sparrow will reship your goods at no added cost.

In case the package is returned to origin due to incomplete address / wrong contact number/ customer refusal / customer out of town / incorrect pin code, Craft Sparrow provides the option of a reshipment at an additional shipping cost of Rs. 70/- in order to reship the goods, to the same or an alternate address. In case you do not wish to reship your package, a refund would be made to your original payment method after the deduction of Rs.70/- as shipping charges. Please note refunds are not applicable on Frames, T-shirts, and customised products: you will have to pay for reshipping in such case as these products are made to order.

Returns and refunds are not applicable on the following categories: Customised Badges, Wedding Badges, Stickers, Posters and Notebooks. A 10% difference may occur in screen color and print color due to screen brightness. Craft Sparrow shall in no way provide any refunds for products that are used or damaged by the buyer.

Intellectual Property

Any and all intellectual property rights associated with the Website and its contents as made available by Craft Sparrow are the sole property of Craft Sparrow and/or its affiliates. You may not copy, imitate, reproduce, modify, amend, lease, loan, sell and/or create derivative works from, upload, transmit, and/or distribute any of the contents of the Website in any form or manner without the prior permission of Craft Sparrow and/or its affiliates, as the case may be. Except as expressly provided herein, Craft Sparrow does not grant any express or implied rights to the intellectual property over the contents of the Website.

By uploading content to or submitting any materials for use on the Web Site, you grant (or warrant that the owner of such rights has expressly granted) Craft Sparrow a perpetual, royalty-free, irrevocable, non-exclusive right and license to use.

Termination:

You agree that Craft Sparrow, at its sole discretion, may terminate or suspend your use of the Website, at any time and for any or no reason at its sole discretion, even if access and use continue to be allowed to others. You agree that Craft Sparrow shall not be liable to you or to any third party for any termination or suspension of your access to the Website.

Craft Sparrow reserves its right to initiate proceedings in accordance with the law against any direct or indirect attack on Craft Sparrow, its owners, employees or third-party contractors and freelancers.

Limitation of Liability:

Craft Sparrow shall not be responsible for any injury, loss, liability, claims, or damage of any kind arising out of your use of the Website. Craft Sparrow shall not be responsible for any direct, indirect, incidental, punitive, exemplary or any other form of damages that is caused by (or connected with) your use of, or your inability to use, this Website on any basis whatsoever. Your remedies are limited to those provided herein to the degree that such limitations are permitted by the law.

Governing law and jurisdiction:

These Terms of Use are governed by the laws of India and are subject to the exclusive jurisdiction of the courts in Aurangabad, India.

Disclaimer of Warranties:

The Website has been made available to you on an as-is basis. Craft Sparrow hereby disclaims all warranties, whether express or implied, and including but not limited to non-infringement, fitness for a particular purpose, and merchantability. No representations and/or warranties are made to you concerning the accuracy or completeness of any of the content uploaded by Craft Sparrow on the Website. No information obtained by you from the Website shall create any warranty not expressly stated by Craft Sparrow.

General:

By agreeing to these Terms of Service, you agree to the Privacy Policy of Craft Sparrow https://craftsparrow.in/privacy-policy by incorporation hereto, and consent to the continuous use and processing of Personal Data by Craft Sparrow for the purposes specified therein. Craft Sparrow is not responsible for any compromise of Personal Data caused by breach of the Website or otherwise.

You may not assign these Terms of Use or any of your interests, rights or obligations under these Terms of Use. If any provision of these Terms of Use shall be found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. You waive any other requirement for these Terms of Use to be proved by means of a written document.
